Kendall County Orders of Protection Attorneys

Orders of Protection Attorneys Serving Oswego, Plainfield, and the Surrounding Communities

According to the Illinois Domestic Violence Act (750 ILCS 60/) abuse is defined as “physical abuse, harassment, intimidation of a dependent, interference with personal liberty or willful deprivation…” If you or your child is in a domestic violence situation, you can obtain relief in the form of an order of protection. Orders of protection provide a legal barrier between the victim and the offender and can help diffuse a dangerous situation.

At the Kendall County family law firm of Goostree Law Group, we are experienced in working with clients facing domestic violence situations. We prioritize our clients’ safety and can assist you in obtaining the orders of protection you need.

Getting Orders of Protection in Kendall County

In Illinois, you can obtain a temporary order of protection on an emergency basis if you or other family members are facing an immediate threat of violence. This emergency order can be issued ex parte (without notifying the accused). For the order to be extended beyond the initial 21 days, however, the accused must be served and allowed to defend him or herself at a hearing. At the hearing, the judge can extend the order for up to 2 years if deemed necessary.

Purpose of Orders of Protection

Depending on the circumstances of the complaint, an order of protection can restrict someone from contacting a victim by phone, email or other means. It can also restrict proximity to the victim including restricting access to the family home and suspending child custody and visitation rights. If the terms of the order are violated, law enforcement must respond and such violations can result in criminal charges.

Orders of protection are not a panacea against domestic violence, but they are a tool to help protect yourself and your family. Our attorneys have years of experience working with clients who are in domestic violence situations. We can help you protect yourself and work with you to resolve other related family law situations such as divorce and child custody matters.
